General Business Terms & Conditions (German AGBs)
Our offers are made on the grounds of information provided to us by our clients. We cannot accept any liability for the accuracy, completeness and actuality of the information given in our sales documentation. Errors, omissions and intermediate sale are excepted. Our offers are exclusively intended for the recipient of the offer. In case of conveyance of such to third parties without our prior approval, the recipient of the offer shall be obliged to pay the full commission if the third party, to whom the estate agent’s information was conveyed, concludes the transaction. We are entitled, even for the other contractual party, to act on behalf of that party and charge commission for our agency work. Our claim to commission shall not be affected by the fact that instead of the originally intended transaction, another transaction is concluded (e.g. renting instead of purchasing) provided the economic success does not deviate substantially from our offer. Should the recipient already be familiar with the property/properties offered by us, this should be notified to us in writing at the latest within five days stating the source and date of the information. The estate agent’s commission of 5.95 % incl. VAT on the purchase price is considered as earned and due upon signing of the contract before a notary and is payable by the buyer to the SAEGER & CIE. GmbH who are granted a direct claim to payment as a result of this. Stamp duty, notaries’ and legal fees shall be borne by the buyer.
